Ögussa takes the protection of your personal data very seriously.  We preserve confidentiality of all personal data you provide us with, in accordance with the applicable data protection regulations, in particular the General Data Protection Regulation (“GDPR”) and the Austrian Data Protection Act as amended (“DSG”).

This Privacy Policy contains information on the data processing that we undertake.   We use the terms set out in the Data Protection Regulation (“GDPR”).  To improve comprehensibility, we would like to explain the most important terms corresponding to their legal definition below.

  • Personal data: any information that relates to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  • Processing: any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organisation, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
  • Data subject: the data subject is the person whose personal data is processed.
  • Controller: the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data.
  • Processor: the natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
  • Consent (of the data subject): any freely given specific, informed and unambiguous indication of his or her wishes in the form of a statement or other unambiguous affirmative act by which the data subject signifies his or her agreement to personal data relating to him or her being processed;

PURPOSE, LEGAL BASIS AND STORAGE DURATION OF THE DATA PROCESSING

1. ENQUIRY VIA ONLINE FORM

1.1 If you make an enquiry using our online contact form, we will collect personal data such as your name (first and last name), company, address (street, postcode, town, country), email address, telephone number, fax number and any other information that you provide voluntarily in the comments field.

1.2 The legal basis for the processing of the above-mentioned data is our legitimate interest, pursuant to Article 6 (1) (f) GDPR, to be able to process your enquiry.

1.3 The provision of your personal data is voluntary. However, if you do not provide certain data (e.g. an email address), we may not be able to process your enquiry.

1.4 We store the above-mentioned personal data for as long as is necessary in order to achieve the respective purpose, e.g. processing your enquiry. After the purpose has been achieved, personal data will be processed for the fulfilment of a legal obligation of the responsible party (e.g. pursuant to Section 132 (1) of the Austrian Federal Fiscal Code (BAO), Sections 190, 212 of the Austrian Commercial Code (UGB): 7 years) or to pursue or defend legal claims (usually for a maximum period of 3 years), whereby in the case of an emerging or concrete procedure, a longer processing of the data may be necessary.

 

2. SETTING UP THE USER ACCOUNT AND PROCESSING ORDERS FOR PRODUCTS

2.1 In order to be able to purchase ÖGUSSA products via our online shop, you need to create a user account. In this context, we process the following personal data pursuant to Article 6 (1) (b) GDPR: user name, email address, password, title, first and last name, contact addresses, payment information, ID number and ID type, as well as any other information that you provide voluntarily.

2.2 We process the above-mentioned personal data for the fulfilment of a contract – to which the data subject is a party (Article 6 (1) (b) GDPR) – in order to set up the user account and process the product orders.

2.3 The provision of your personal data is necessary for the fulfilment of the contract, so that we may enter into a contractual relationship with you. Without the provision of your personal data, we cannot provide you with our services.

2.4 We store the above-mentioned personal data as long as is necessary in order to achieve the respective purpose, e.g. processing of the respective order. After the purpose has been achieved, personal data will be stored in order to fulfil a legal obligation of the responsible party (e.g. pursuant to Section 132 (1) BAO, Sections 190, 212 UGB: 7 years) or to pursue or defend legal claims (usually for a maximum period of 3 years), whereby a longer processing of the data may be necessary in the case of emerging or concrete proceedings.

RECIPIENTS

Insofar as we use processors pursuant to Article 4 (8) GDPR who process personal data on our behalf (e.g. software suppliers, service providers), they may only process the data provided to them in accordance with our instructions and to perform services for us pursuant to Article 28 GDPR. In the case of data transfers outside the EEA, we contractually oblige these processors to guarantee the confidentiality and security of the personal data processed within the scope of the contract.

We have concluded a contract with Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA) for commissioned data processing pursuant to Article 28 GDPR.

We may transfer your personal data on the basis of legal or contractual obligations or existing legitimate interests (such as to pursue or defend legal claims) to certain recipients, such as: courts, public authorities, our legal representation and accountants as well as contractual and business partners.

WHAT ARE YOUR RIGHTS?

You have the following rights vis-à-vis ÖGUSSA: right (i) of access (Article 15 GDPR); (ii) to rectification (Article 16 GDPR); (iii) to erasure (Article 17 GDPR); (iv) to restriction of processing (Article 18 GDPR); (v) to object (Article 21 GDPR);

(vi) to data portability (Article 20 GDPR); (vii) to lodge a complaint with the competent supervisory authority (Article 77 GDPR), whereby in Austria the competent authority is the Data Protection Authority, Barichgasse 40-42, 1030 Vienna (www.dsb.gv.at).
